What is Unlawful Discrimination?

Unlawful discrimination is when an employer treats an employee worse than others based on a particular characteristic. This behavior is wrong and illegal and there are several forms of it.

Racial & Religious Discrimination. Racial and religious discrimination can include obvious things such as racial slurs, offensive jokes, or threats. Indirect discrimination can include being treated differently in the workplace.

These include, but are not limited to, less pay than the opposite sex, being denied job opportunities, or being passed over for a promotion based purely on a person’s gender identity or sexual orientation. Harassment is a form of discrimination and can be in the form of sexist epithets, unwanted physical contact, and offensive jokes.

Age Bias. Age bias is when an older employee is laid off or terminated because of how old they are. This can be harder to prove, but not impossible. It usually occurs when a company changes management and wants to cut costs. Managers will target older workers, claiming they cannot handle their workload.

Pregnancy & Disability. Disability discrimination happens when an employer refuses to hire a person based on their mental or physical impairments. Pregnancy also falls under this law. The law states that a company must make accommodations and exceptions for those who are pregnant or have disabilities unless it would cause the company undue hardship.

Military. Refusing to hire someone based on military status is illegal. Even though they may be called to serve, an employer cannot choose to terminate or refuse to hire someone for this reason. If the employee gives notice and is not away for longer than five years, an employer must give them their job back.
